What Constitutes Sexual Abuse in Arizona?

Either one of the following instances are considered sexual abuse in Arizona:

  • Intentionally or knowingly engaging in sexual contact with an individual aged 15 or older without his or her consent
  • Intentionally or knowingly engaging in sexual contact with an individual younger than 15 when the contact only involves the female breast

Sexual contact refers to direct or indirect touching of the sexual areas of the body using any part of one’s body or with an object. These cases may be referred to as "fondling cases."

Engaging in sexual contact with a minor younger than 15 years old where the conduct was not limited to contact with the female breast, but involved other sexual acts, is classified as "child molestation" and carries more serious penalties.

Sexual Abuse Penalties

A first-offense conviction of sexual abuse against someone aged 15 or older is punishable by probation up to a year in jail or six months up to two and one-half years in prison. Penalties are enhanced for those with prior convictions.

A conviction of sexual abuse against a minor under the age of 15, is punishable by two and one-half, five, or seven and one-half years in prison. Mandatory registration as a sex offender is required when victims are under the age of 18.
